Terms & Conditions

1. Acceptance of Terms

By accessing, browsing, or using FRANK AI in any capacity - including creating an account, downloading our mobile applications, subscribing to any plan, or using any feature - you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy .

If you do not agree to these Terms, you must immediately discontinue use of the platform and delete any installed applications. Your continued use constitutes acceptance.

If you are using FRANK AI on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.

2. Definitions

"Platform" - the FRANK AI website, mobile applications (iOS and Android), APIs, and all associated services
"User" / "You" - any individual or entity accessing or using the Platform
"Account" - your registered profile on FRANK AI, created via Hercules Auth
"Content" - all text, images, data, documents, media, AI-generated material, and other information available on or through the Platform
"User Content" - any content uploaded, submitted, or created by you on the Platform
"Subscription" - a paid or free membership plan that grants access to specific features and services
"FFSM" - FRANK Franchise Sales Manager, an authorized partner operating within the FRANK AI ecosystem
"Affiliate" - a registered referral partner earning commissions through the FRANK AI partner program
"AI Services" - features powered by artificial intelligence, including deal scoring, content generation, legal summaries, and market analysis
"DLD Data" - publicly available transaction data from the Dubai Land Department

3. Eligibility

You must be at least 18 years of age to use FRANK AI
You must have the legal capacity to enter into a binding agreement
If you are a real estate professional, you represent that you hold valid and current licenses required by UAE authorities (e.g., RERA registration)
You may not use the Platform if you have been previously suspended or terminated by FRANK AI
You may not use the Platform from jurisdictions where such use would violate local laws

4. Account Registration & Security

Account creation is facilitated through Hercules Auth, supporting sign-in via Google, Microsoft, and email with one-time password (OTP)
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account
You agree to provide accurate, current, and complete information during registration and to update it as necessary
You must notify us immediately of any unauthorized use of your account or any security breach
FRANK AI reserves the right to suspend or terminate accounts that violate these Terms or are associated with fraudulent activity
One person or entity may maintain only one account unless specifically authorized (e.g., FFSM accounts)

5. Description of Services

FRANK AI provides the following services (subject to subscription tier):

Market Intelligence - real-time Dubai real estate market data, DLD transaction analytics, area profiles, and comparative market analysis
Deal Scoring - AI-powered property deal evaluation and investment scoring based on transaction data
Launch Intelligence - off-plan project tracking, new launch alerts, developer profiles, and inventory management
Client Pack Generator - automated creation of branded client presentations and property portfolios
Media Generator - AI-powered creation of marketing materials, social media content, and property visuals
Closing Room - transaction management workspace for deal pipelines
Legal Advisor - AI-generated legal information and regulatory guidance (not legal advice)
Dictionary - comprehensive Dubai real estate terminology glossary
FRANK Challenge - gamified real estate knowledge assessment
WhatsApp Integration - two-way communication and document sharing via WhatsApp Business
Outreach & Campaigns - tools for marketing communication and lead generation

Services may be modified, expanded, or discontinued at our discretion. Material changes to paid features will be communicated in advance.

6. Subscriptions & Billing

a) Plans & Pricing

FRANK AI offers multiple subscription tiers with varying features, usage limits, and pricing
Current plan details and pricing are available on the Memberships page
Free-tier users have access to limited features with usage caps that reset periodically

b) Payment Processing

All payments are processed securely through Stripe
We accept major credit and debit cards. Accepted payment methods may vary by region
All prices are displayed in the currency specified at the time of purchase (typically AED or USD)
Applicable taxes (including UAE VAT at 5%) are added where required by law

c) Billing Cycle & Renewal

Subscriptions are billed on a recurring monthly or annual basis depending on the plan selected
Your subscription will automatically renew at the end of each billing period unless cancelled prior to renewal
Renewal charges are processed using the payment method on file
You will receive a reminder notification before each renewal

d) Cancellation & Refunds

You may cancel your subscription at any time through your account dashboard or by contacting support
Cancellation takes effect at the end of the current billing period - you retain access until then
Refunds are generally not provided for partial billing periods. Exceptions may be made at FRANK AI's sole discretion
If a refund is approved, it will be processed to the original payment method within 5-10 business days

e) Price Changes

We reserve the right to change subscription pricing with at least 30 days' prior notice
Price changes will apply at the start of the next billing cycle following the notice period
If you do not agree to a price change, you may cancel your subscription before the new price takes effect

7. Free Trials & Promotions

FRANK AI may offer free trials, promotional discounts, or coupon codes at its discretion
Free trials automatically convert to paid subscriptions at the end of the trial period unless cancelled
Promotional codes are non-transferable, cannot be combined with other offers, and may have expiration dates or usage limits
FRANK AI reserves the right to revoke promotional offers that are obtained through fraud, misrepresentation, or in violation of the program terms
Unregistered users may be granted a limited number of free feature uses ("tries") per session. These resets are at FRANK AI's discretion

8. Mobile Applications

FRANK AI is available for download on the Apple App Store (iOS) and Google Play Store (Android)
By downloading and using our mobile applications, you agree to these Terms as well as the applicable app store terms of service
License Grant: We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the mobile application on devices you own or control, solely for personal or internal business use
You may not modify, reverse-engineer, decompile, disassemble, or create derivative works from the mobile applications
App updates may be released periodically. We recommend keeping auto-updates enabled for the best experience and security patches
Certain features may require an active internet connection. We are not responsible for data charges from your carrier
In-app purchases, if available, are processed through the respective app store's payment system and subject to their refund policies

9. Acceptable Use Policy

You agree NOT to:

Use the Platform for any unlawful purpose or in violation of any applicable local, national, or international law
Attempt to gain unauthorized access to any part of the Platform, other accounts, or connected systems
Interfere with, disrupt, or place an unreasonable load on the Platform's infrastructure
Scrape, crawl, or use automated tools to extract data from the Platform without written authorization
Use AI-generated content from FRANK AI to intentionally mislead, deceive, or defraud third parties
Resell, redistribute, or commercially exploit Platform data, features, or content without a written license
Upload malicious software, viruses, or harmful code
Impersonate another person, entity, or FRANK AI representative
Harass, abuse, or threaten other users or FRANK AI staff
Use the Platform to send unsolicited commercial communications (spam)
Circumvent or attempt to circumvent usage limits, subscription restrictions, or access controls
Share your account credentials or allow unauthorized individuals to access your account

Violation of this Acceptable Use Policy may result in immediate account suspension or termination, without prior notice or refund.

10. Intellectual Property

a) FRANK AI Ownership

The FRANK AI name, logo, brand identity, software, algorithms, AI models, design, layout, and all original content are the exclusive property of RE FRANK TECHNOLOGY L.L.C
All trademarks, service marks, and trade dress are registered or unregistered marks of FRANK AI
The Platform is protected by copyright, trademark, patent, and other intellectual property laws of the UAE and international treaties

b) Restrictions

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of the Platform without prior written consent
You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices
Screenshots and limited quotations are permitted for non-commercial, editorial purposes with proper attribution

c) DLD & Public Data

Certain market data displayed on the Platform is sourced from publicly available Dubai Land Department records
While the underlying public data may not be proprietary, our compilation, analysis, scoring algorithms, and presentation of such data are protected intellectual property

11. User-Generated Content

You retain ownership of content you create and upload to the Platform (documents, images, property listings, notes)
By uploading content, you grant FRANK AI a non-exclusive, worldwide, royalty-free license to use, store, process, display, and distribute that content solely for the purpose of providing and improving our services
You represent and warrant that you have all necessary rights and permissions to upload any content
FRANK AI may remove or disable content that violates these Terms, infringes on third-party rights, or is otherwise objectionable
We are not responsible for User Content and do not endorse any opinions, recommendations, or advice contained therein
You agree to indemnify FRANK AI against claims arising from your User Content

12. AI-Powered Services

Important: AI-generated content is provided for informational purposes only and does not constitute professional advice of any kind.

Not Professional Advice - deal scores, legal summaries, market analyses, and all other AI-generated content are informational tools. They are NOT investment advice, legal counsel, financial guidance, or professional real estate appraisals
No Guarantee of Accuracy - AI models may produce inaccurate, incomplete, or outdated information. Always verify AI-generated content with qualified professionals before making decisions
Limitation of Reliance - any reliance you place on AI-generated content is strictly at your own risk. FRANK AI shall not be liable for decisions made based on AI output
Content Ownership - AI-generated content created through FRANK AI tools may be used by you for personal and business purposes. However, identical or similar outputs may be generated for other users
Training & Improvement - anonymized inputs and outputs may be used to improve our AI models. Your personal data is not shared with third-party AI providers beyond what is necessary for processing

13. Data Accuracy & Disclaimer

Market data, property prices, transaction volumes, and analytics are derived from sources we believe to be reliable, including the Dubai Land Department, but we do not guarantee their accuracy, completeness, or timeliness
Property availability, pricing, and project details for off-plan developments are provided by third-party developers and may change without notice
FRANK AI is not a licensed real estate brokerage, valuation firm, or financial institution. Nothing on the Platform constitutes an offer, solicitation, or recommendation to buy, sell, or invest in any property
Users should conduct their own independent due diligence and consult with licensed professionals before making any real estate investment or transaction decisions
Historical data and projections do not guarantee future performance or returns

14. Affiliate & Partner Program

The FRANK AI Affiliate Program allows approved partners to earn commissions by referring new subscribers
Affiliate participation is subject to approval and additional program-specific terms communicated during onboarding
Commission rates, payment schedules, and attribution windows are set by FRANK AI and may be modified with 30 days' notice
Affiliates must not use deceptive, misleading, or unethical practices to generate referrals
FRANK AI reserves the right to withhold commissions and terminate affiliate accounts for violations of program terms
FFSM partners operate under separate franchise agreements that supplement these Terms

15. Third-Party Services & Links

The Platform integrates with and links to third-party services including Stripe, WhatsApp, Apple App Store, Google Play Store, and others
Your use of third-party services is governed by their respective terms and privacy policies
FRANK AI is not responsible for the availability, accuracy, content, or practices of third-party services
Inclusion of third-party links does not imply endorsement or affiliation
We are not liable for any loss or damage arising from your use of third-party services accessed through the Platform

16. Termination & Suspension

a) By You

You may terminate your account at any time by contacting support or through your account settings
Upon termination, your access to paid features will continue until the end of the current billing period
You may request deletion of your personal data in accordance with our Privacy Policy

b) By FRANK AI

We may suspend or terminate your account immediately, without prior notice, for violation of these Terms
We may suspend accounts for suspected fraud, security concerns, or non-payment
We may terminate dormant accounts after 24 months of inactivity with prior notice

c) Effect of Termination

Upon termination, your right to use the Platform ceases immediately
We may retain certain data as required by law or for legitimate business purposes
Sections of these Terms that by their nature should survive termination (including IP, liability, indemnification, and dispute resolution) will survive

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
FRANK AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM
IN NO EVENT SHALL FRANK AI'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO FRANK AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR AED 1,000, WHICHEVER IS GREATER
FRANK AI DOES NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR SECURE ACCESS TO THE PLATFORM. SCHEDULED AND UNSCHEDULED MAINTENANCE MAY TEMPORARILY IMPACT AVAILABILITY

18. Indemnification

You agree to indemnify, defend, and hold harmless FRANK AI, RE FRANK TECHNOLOGY L.L.C, and their officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your use of or access to the Platform
Your violation of these Terms
Your User Content or any content you submit, post, or transmit through the Platform
Your violation of any third-party rights, including intellectual property or privacy rights
Any decisions or actions you take based on data, AI-generated content, or information obtained through the Platform

19. Dispute Resolution

a) Informal Resolution

Before initiating any formal proceedings, you agree to first contact us at admin@frankai.ae and attempt to resolve the dispute informally within 30 days.

b) Arbitration

If the dispute cannot be resolved informally, it shall be submitted to binding arbitration administered by the Dubai International Arbitration Centre (DIAC) under its prevailing rules. The arbitration shall be conducted in English in Dubai, UAE, by a single arbitrator.

c) Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict of law principles. The courts of Dubai, UAE shall have exclusive jurisdiction over any matters not subject to arbitration.

21. Changes to Terms

FRANK AI reserves the right to modify these Terms at any time
Material changes will be communicated via email, in-app notification, or prominent notice on the Platform at least 15 days before they take effect
Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms
If you disagree with the changes, you must stop using the Platform and may request account deletion

22. Severability & Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect
The failure of FRANK AI to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision
These Terms, together with the Privacy Policy and any additional agreements you enter into with FRANK AI, constitute the entire agreement between you and FRANK AI regarding the Platform
